Increase in foreign companies' shareholding in Brazilian airlines revoked

The Vice-President in office, Michel Temer, sanctioned yesterday, July 25, 2016, Law No. 13.319, which revokes the expansion of foreign participation in Brazilian airlines brought by Provisional Measure No. 714, of March 1, 2016.

This provisional measure increased the legally authorized participation of foreigners in the voting capital of Brazilian airlines from 20% to 49%, and allowed participation of up to 100% if there was reciprocity in the treatment of Brazilians in the country of origin of the foreigner who wished to participate in a Brazilian airline.

In the legislature, the reciprocity requirement was removed, which was harshly criticized by industry experts. It was therefore expected that Vice President Temer would simply veto the unnecessary nature of reciprocal treatment, maintaining the advances brought about by the Provisional Measure.

Political insiders say the Vice President was influenced by some Senators opposed to the increase. The Senate is currently hearing the impeachment trial of President Dilma Rousseff.
