Considering that some of the most prominent supporters of PL 186/2014 (which, contrary to PL 442/1991, was proposed by the Senate), are seriously involved in Operation Car Wash, PL 442/1191 may “steal the spotlight” from PL 186/2014, becoming the main norm to regulate gambling and betting in Brazil.
Many of the provisions of Bill 442/1991 are similar to those of Bill 186/2014 (such as the requirement of incorporation of a Brazilian company, tax compliance, and absence of a criminal record). In contrast, Bill 442/1991 expressly prohibits online gambling (including sports betting in general), presenting a closed list of permitted games that includes only: (a) casino games; (b) bingo; (c) state lotteries; and (d) jogo do bicho (animal game). Interestingly, these games are referred to in Bill 442/1991 as "games of fortune," whereas in Bill 186/2014 the term used is "games of chance."
Furthermore, it appears that the members of the Special Committee, already anticipating strong opposition from the Federal Public Ministry (considering that this body was against PL 186/2014 for fear that the legalization of gaming and betting could increase money laundering), included stricter control mechanisms for the exploration of activities related to gaming and betting.
A request for the distribution of the matter to exclude the consideration of PL 442/1991 by the Plenary of the Chamber, including the conclusive consideration of the Special Committee, was filed by deputy Mário Negromonte, on the same day of its approval.
