FIVE-YEARLY CENSUS OF FOREIGN CAPITAL IN BRAZIL FOR THE BASE YEAR ENDED DECEMBER 31, 2020

The Central Bank of Brazil (“BACEN”), through Circular No. 3.795/2016, established the rules regarding the declaration of the Five-Year Census of Foreign Capital in Brazil for the base date of December 31 of the previous year.

The declaration of the Five-Year Census of Foreign Capital is conducted by BACEN with the objective of compiling statistics on the external sector, especially the International Investment Position, subsidizing the formulation of economic policy and assisting the activities of economic researchers and international organizations.

Therefore, in 2021, the declaration of the Quinquennial Census for the base year ending December 31, 2020 must be submitted, from July 1st until August 16, 2021 at 18:00 p.m..

The following entities are required to submit the aforementioned declaration for the Five-Year Census for the base year of December 31, 2020:

  • Brazilian legal entities with direct participation of non-residents in their share capital, in any amount, on December 31, 2020;
  • Investment funds with non-resident shareholders, as of December 31, 2020; and
  • Brazilian legal entities with a total outstanding balance of short-term commercial credits (payable within 360 days) granted by non-residents equal to or greater than the equivalent of US$1.000.000,00 (one million US dollars) on December 31, 2020.[1]

Failure to provide the information required by BACEN, or providing false, incomplete, incorrect information or information outside the deadlines and conditions provided for in the legislation, will result in the imposition of fines that may reach up to R$250.000,00 (two hundred and fifty thousand reais).
