Criminal lawyer from Montgomery & Associados is reappointed to the Special Study Committee on “Criminal Compliance” of the Brazilian Bar Association, São Paulo Section

By means of Ordinance No. 551/16/PR, the president of the Brazilian Bar Association, São Paulo Section, Dr. Marcos da Costa, appointed lawyer Luís Fernando Diegues Cardieri, responsible for the Corporate Criminal Law area of ​​Montgomery & Associados, to join, as an effective member, the Special Committee for Studies on Criminal Compliance.

With the advent of Law No. 12.846/2013, known as the “Anti-Corruption Law” or “Compliance Law”, the scope of compliance programs reached different spheres of business activity, from preventive issues in environmental matters, consumer protection, preventive measures against criminal behavior related to economic, tax, financial issues and even regulatory frameworks for the exercise of work activities.

The process of compliance programs is guided by the preventive purpose, through the programming of a series of conducts that reduce the risks of business activity, based on ethical principles, standards of conduct, regulations, procedures and internal controls, which generate mechanisms to protect against punishable risks, including in the criminal area.

In the current national scenario, companies that intend to behave appropriately in competitive terms, or seek to protect themselves legally, must seek appropriate criminal protection.

The Commission will study sector-specific legislation in light of this new labor market. Its members are professionals with extensive experience in criminal law, working at leading law firms in São Paulo. They will discuss improvements to legislation on the topic and observe the laws' practical applicability.
